1. Applicable law, contract content, and responsible parties

Nomad Wildtracks BCN (“Nomad Wildtracks”) is a limited liability company, domiciled in Cabrils, Barcelona.

This contract exclusively regulates the rental of camperized 4×4 vehicles with standard or customized equipment, offered by Nomad Wildtracks to the renter. Nomad Wildtracks does not provide travel services.

Contractual documents:

  1. 1. The rental contract with the specific agreed conditions.
  2. 2. The vehicle condition report at the start of the rental.
  3. 3. The reservation confirmation sent by email.
  4. 4. These general conditions.

Renter’s liability:

The use of the vehicle is under the full responsibility of the renter, who independently organizes their trip.

These conditions apply to:

  • The person who signs the contract.
  • Any person who provides a bank card as guarantee or payment, even if not the contract holder.
  • All authorized drivers.

Payment and guarantees:

  • The holder of the card used as guarantee is responsible for all costs derived from the rental.
  • In case of payment made by a third party (not the contract signer), if this rejects the charge, Nomad Wildtracks may demand payment from the renter and authorized drivers jointly.
  • All persons identified in the contract are jointly liable for any outstanding amount.

2. Who can rent a 4×4 vehicle from Nomad Wildtracks?

Anyone who meets the following requirements can rent:

  • Be legally capable of entering into a contract and accept responsibility for the vehicle during the rental period.
  • Be at least 25 years old and have at least 2 years of driving license seniority.
  • Have the payment methods accepted by Nomad Wildtracks to cover the rental and associated expenses.

Accepted payment methods:

  • Credit or debit card (VISA and MasterCard).
  • Cash (within legal limits established in Spain).

Required documents:

  • EU citizens: Passport or ID + valid Spanish driving license.
  • Non-EU citizens: Passport + valid Spanish driving license.
  • International driving permit is mandatory for US and Canadian citizens, issued according to Annex 10 of the Geneva Convention.

Note: All documents must be valid throughout the rental period. The international driving permit must always be accompanied by the corresponding national license.


3. Who can drive the 4×4 vehicle?

Only the following may drive the vehicle:

  • The renter and any person expressly identified as authorized driver in the rental contract.
  • Who are at least 25 years old and hold a valid driving license with a minimum seniority of 2 years.
  • Who have presented a valid identity document (ID or passport).

Restrictions:

  • No other person may drive the vehicle. If driven by an unauthorized person, the renter is fully responsible for any damage or consequences.
  • In this case, the contracted insurance will not cover the renter nor the unauthorized driver, except for the mandatory Civil Liability Insurance.

Passengers and maximum capacity:

  • The maximum number of persons authorized to travel in the vehicle is 5.
  • If you wish to add an additional tent to accommodate more people outside the vehicle, you must inform Nomad Wildtracks in advance and contract the necessary accessories.
  • Nomad Wildtracks reserves the right to refuse delivery if the information about passengers is incomplete or incorrect.

4. Where and how can I drive the vehicle?

Allowed circulation area:

The vehicle may be driven within a set of countries previously authorized by Nomad Wildtracks, according to the itinerary communicated by the renter.

  • Before traveling outside Spain, the renter must inform Nomad Wildtracks of their complete itinerary, including the countries to visit and whether the vehicle will be transported by ferry.
  • Nomad Wildtracks will validate the itinerary and may apply, if applicable, an additional management and risk surcharge.
  • Any change during the trip must be communicated and approved by Nomad Wildtracks.
  • Ferry trips within Spain do not require notification.

Important:

  • Failure to comply with these conditions may result in contract termination and responsibility for all costs and damages.
  • Nomad Wildtracks may verify compliance using the geolocation system.

Permitted use of the vehicle:

  • The vehicle shall only be used for private purposes such as vacations, daily use, or similar.
  • Commercial use is prohibited, except those expressly authorized by Nomad Wildtracks (e.g., as a mobile office or for creative activities like photography, video, etc.).

Prohibited use:

  • Participation in motor sports events, vehicle testing, or extreme driving.
  • Transport of explosive, flammable, toxic, or hazardous materials.
  • Use for moving, subleasing, lending, or committing illegal acts.
  • Removing or covering Nomad Wildtracks logos with stickers or other elements.
  • Subleasing, selling, or pledging the vehicle or its components.
  • Transporting passengers for profit.
  • Carrying more occupants than allowed.
  • Transporting live animals without express authorization (except pets).
  • Towing other vehicles without specific authorization.
  • Smoking inside the vehicle (subject to penalty).

Nomad Wildtracks may refuse vehicle delivery if doubts exist about the intended use.


5. Client obligations regarding the rented 4×4 vehicle

Return and care of the vehicle:

  • The vehicle, along with its keys, accessories, and documentation, must be returned on the agreed date and time, with a 30-minute courtesy margin.
  • In case of delay, Nomad Wildtracks may apply charges described in the Rate Guide and take legal action for vehicle recovery.
  • You must ensure to refuel with the appropriate fuel and keep the vehicle in correct conditions, including basic checks (oil, water, tires).
  • The vehicle must be locked and protected by anti-theft devices when not in use.
  • Nomad Wildtracks may demand immediate return of the vehicle in case of serious breach of these obligations.

Proper use of the vehicle:

  • You and any authorized driver must drive responsibly and comply with applicable traffic laws.
  • All tolls, fines, and penalties resulting from vehicle use will be the renter’s responsibility.
  • Driving under the influence of alcohol, drugs, or any substance that impairs driving ability is prohibited.
  • Luggage transported must be properly secured to prevent damage or risk.

6. Services included in the 4×4 vehicle rental

The basic rental rate includes the following services:

  • 24/7 roadside assistance provided by the insurance company, valid in countries authorized by Nomad Wildtracks.
  • Exterior and interior cleaning of the vehicle by Nomad Wildtracks at the end of the rental. However, the living cell must be returned in a reasonably clean condition. If the interior shows excessive dirt, food remains, trash, or significant stains, an additional cleaning fee will be charged (€100).
  • Comprehensive insurance with a deductible of €3,000, included in the basic rate.
  • Unlimited mileage throughout the rental period.
  • Extension of the rental period subject to availability, with prior written consent and prepayment of the additional days.

Optional coverage:

  • Premium coverage package: reduces the deductible to €600 + includes an additional driver, for €35/day.

7. What is included in the rental price and what is not included

Includes:

  • The daily rental rate for the 4×4 vehicle, for the agreed number of calendar days.
  • The standard included services (detailed in the previous section).
  • Applicable VAT.
  • Maintenance and repair costs arising from normal use of the vehicle.
  • Full Omnium insurance coverage with a €3,000 deductible (option to reduce with the Premium package).

Does not include:

  • Tolls, fuel, parking fees, camping fees, ferry, or other transport means.
  • Fines, penalties, or expenses arising from legal violations.
  • Additional cleaning costs if the living unit is returned in inadequate conditions.

Authorization of charges:

By signing the contract, the renter expressly authorizes Nomad Wildtracks to charge their payment method for all pending amounts related to:

  • Fines and their processing costs.
  • Vehicle damages.
  • Management of unpaid tolls.

Unusual behavior:

Nomad Wildtracks reserves the right to review vehicle use if it suspects inappropriate driving, including repetitive routes or use outside the agreed terms. In such cases, the renter will be responsible for additional damages.

Note:

Promotional discounts are not cumulative.

Any modification to the reservation may affect the final price.


8. Other charges or costs applicable to the rental contract

Security deposit:

In addition to the rental price, a bank pre-authorization will be requested corresponding to the amount of the chosen deductible:

  • €3,000 for the standard option.
  • €600 if the Premium Guarantee is contracted.

Other possible charges:

  • Administrative costs for managing fines and tolls (in addition to the fine amount).
  • Special cleaning if the vehicle is returned in unacceptable conditions.
  • Loss or theft of keys or other items.
  • Loss of vehicle documents.
  • Damages not covered by the contracted insurance.
  • Fuel not refilled upon vehicle return.
  • Delays in vehicle return.
  • Any other duly justified extraordinary expense.

9. Booking, Payment and Cancellation

Booking Confirmation:

The booking will only be binding when:

  • The renter receives written confirmation.
  • The corresponding deposit has been paid:
    • 30% of the total amount if the booking is made more than 30 days in advance.
    • 50% if the booking is made between 30 and 15 days in advance.

The remaining amount (70% or 50%) must be paid 15 days before the trip. A link will be sent by email to complete the payment easily and securely.

If the booking is made less than 15 days in advance, the total rental amount must be paid at the time of booking confirmation.

Cancellation Conditions:

  • Cancellations more than 30 days in advance: 100% refund of the amount paid.
  • Between 15 and 30 days before the rental starts: 50% refund of the amount paid.
  • Less than 15 days before the rental starts: No refund. In case of duly justified force majeure, we may offer a voucher or date change, depending on availability.

All cancellations must be requested in writing (email or WhatsApp).

Payment Methods:

  • Credit/debit card (VISA/MasterCard).
  • Cash within legal limits.

10. Deposit and payment method

10.1. To confirm the reservation, the renter must pay a deposit according to the conditions detailed in the payment policy (see section 9). The remaining balance will be secured by a bank pre-authorization as established.

10.2. As a guarantee to cover possible damages, delays, or contractual breaches, the renter authorizes Nomad Wildtracks to carry out a bank pre-authorization on their credit card for the amount corresponding to the deposit:

  • €3,000 for the standard option.
  • €600 if the renter contracts the Premium Guarantee (€35/day rental).

The pre-authorization will be made 48 hours before the rental start. If the deposit pre-authorization cannot be completed, Nomad Wildtracks reserves the right to cancel the reservation without refunding the paid deposit.

10.3. The deposit will cover, among other things:

  • Vehicle damages (bodywork, interior, mechanics).
  • Damages to the living unit and interior equipment (furniture, appliances, utensils).
  • Loss or damage of keys, vehicle documentation, or accessories.
  • Special cleaning in case of return in inadequate conditions.
  • Unauthorized delays in return.
  • Any fines, penalties, or legal costs derived from vehicle use during the rental period.
  • Costs arising from immobilization or retention of the vehicle due to improper use.

10.4. The pre-authorization will be automatically released after the vehicle return, once its condition and contract compliance are verified, within a maximum of 48 hours. If hidden damages or breaches are detected, Nomad Wildtracks may claim the corresponding amount within a maximum of 30 days, using the deposit or invoicing the difference.

10.5. In case of accident, the deposit may be retained until the claim is resolved, especially if other parties are involved and responsibility is not clearly determined.

10.6. The lessor reserves the right to claim any additional expenses arising from contractual breaches, fines, or damages, deducting them directly from the deposit.


11. Rental period and delivery/return times

The rental period extends from the agreed delivery of the vehicle until its final return, at the following times:

  • Vehicle delivery to the renter: between 10:00 and 15:00 hours.
  • Vehicle return: between 10:00 and 15:00 hours on the agreed day.

Nomad Wildtracks does not guarantee the delivery of a vehicle the same day another client returns it. For logistical and maintenance reasons, a minimum period of at least 24 hours between two consecutive rentals may be required.

  • Minimum rental period: 2 full days.
  • Delay in return: a charge of €50.00 per additional hour will apply, up to a maximum of €500 per 24 hours.

12. Vehicle Pickup and Return of the 4×4

Vehicle Pickup:

The vehicle pickup will preferably take place at the Nomad Wildtracks base located in Cabrils (Barcelona), between 10:00 AM and 3:00 PM on the agreed day.

At the renter’s request, Nomad Wildtracks can arrange:

  • Vehicle delivery at Barcelona-El Prat Airport or Girona-Costa Brava Airport, with a cost of €55 per service.
  • Or a private transfer service from these airports to Cabrils, also for €55 per trip. This service must be requested in advance and is subject to availability.

Inspection and Documentation:

Upon vehicle pickup, a condition report will be signed along with a Nomad Wildtracks agent. The renter must review the vehicle and report any damage not reflected in the report before departure. If no modifications are noted at that time, the vehicle will be considered accepted as described.

Vehicle Return:

  • Return must be made at the agreed place and time, preferably in Cabrils, between 10:00 AM and 3:00 PM.
  • Nomad Wildtracks may accept returns at the aforementioned airports, with the corresponding charges stated above (€55 per service).
  • The vehicle must be returned with a full fuel tank. Otherwise, a fixed charge of €30 will apply, plus the cost of the fuel needed to fill the tank.
  • Early return does not entitle a refund.
  • A joint inspection will be performed upon vehicle return. Nomad Wildtracks will send an official confirmation of return by email.
  • Nomad Wildtracks is not responsible for personal belongings left in the vehicle. If items are found, the client will be notified if possible, but there is no guarantee of recovery.

Late Return:

  • A charge of €50 per hour will be applied, up to a maximum of €500 per day.
  • If the delay affects another reservation, the renter must compensate for lost income.
  • If there is no return or contact within 24 hours after the agreed time, Nomad Wildtracks may take legal action to recover the vehicle, including reporting to the competent authorities.

13. Vehicle Damage

If damages not reflected in the initial delivery report are identified upon vehicle return, the following procedure will apply:

a) Damages identified at the time of return:

  • The vehicle will be inspected in your presence along with a Nomad Wildtracks agent.
  • If damages are detected and you acknowledge them by signing the return report, Nomad Wildtracks will provide an estimated repair budget.
  • This estimate will be issued by a specialized workshop or an independent expert appointed by Nomad Wildtracks.

b) In case of disagreement:

  • If you disagree with the damages or costs indicated and decide not to sign the return report, Nomad Wildtracks will still carry out the damage assessment by an independent expert.
  • You will receive a detailed report with the estimated repair cost within 5 business days.
  • You will have 7 calendar days from receipt of the report to submit your observations or present your own assessment.

General Conditions:

  • Liability for damages may be limited or covered, fully or partially, if you have contracted additional protection (see Insurance and Protection Conditions).
  • Nomad Wildtracks will only charge the amount corresponding to the actual damages and your coverage contracted.

14. Vehicle Maintenance

During the rental, the renter must take care of the vehicle as if it were their own, performing the necessary basic checks to ensure proper operation:

  • Regularly check the oil and coolant levels.
  • Check the pressure and condition of the tires.
  • Pay attention to any warning lights on the dashboard and act accordingly.

You must take all reasonable measures to protect the vehicle and keep it in good condition during use.

It is forbidden to make any mechanical modifications or interventions on the vehicle, its keys, or accessories without prior written authorization from Nomad Wildtracks.

In case of failure to comply with these obligations and if damages or deterioration occur due to lack of basic maintenance, the renter will be responsible for the expenses necessary to restore the vehicle to its original condition.


15. What to do in case of accident, mechanical breakdown, or theft of the vehicle

During your trip, if you suffer a mechanical breakdown or accident that prevents you from continuing, you have access to a 24-hour roadside assistance service included in your rental.

Procedure:

  • In case of accident, you must inform us within 24 hours, providing an accident report and any useful documents.
  • In case of theft, you must report the incident and deliver the original police report within 24 hours, along with the vehicle’s original keys, except in cases of force majeure.

16. Repair and Maintenance

During the rental period, the renter agrees to take care of the vehicle and keep it in good condition, as it was received.

Specific obligations of the renter:

  • Regularly check oil level, coolant level, and tire pressure.
  • Be alert to any warning lights on the dashboard and follow the basic operating instructions of the vehicle.

Costs borne by the renter:

  • All costs arising from the daily use of the vehicle, such as fuel, routine cleaning, and any products necessary for basic maintenance.
  • Repairs caused by negligence, misuse, or failure to comply with stipulated maintenance conditions.

Costs borne by Nomad Wildtracks:

  • Costs arising from normal wear due to prior use.
  • Repairs necessary to ensure operational safety, as long as they are not due to improper use.

Modifications or repairs:

  • It is forbidden to carry out any modification, mechanical intervention, or manipulation without prior written authorization from Nomad Wildtracks.
  • In emergencies, if a repair necessary for safety is required, the renter must contact Nomad Wildtracks beforehand. Costs will be reimbursed upon invoice presentation, unless the damage was caused by improper use.

17. Renter’s Liability and Insurance

Nomad Wildtracks’ vehicle is insured with a full coverage insurance (Full Omnium) with a standard deductible of €3,000 per claim.

Deductible Reduction:

  • The renter may reduce this deductible to €600 by purchasing the Premium Guarantee, available for €35/day.

Renter’s Liability:

The renter will be fully responsible for damages caused by:

  • Improper use of the vehicle (e.g., driving off paved roads without authorization).
  • Refueling errors (filling the water tank with diesel or the fuel tank with another liquid).
  • Damage caused by misuse of the awning, pop-up roof, or any interior vehicle components.
  • Use of the vehicle on ferries or trains without prior written authorization.
  • Gross negligence, breach of contractual conditions, or participation in prohibited activities.

Excluded Coverages:

Liability waiver does not cover:

  • Operational damages caused by misuse of the vehicle or its components.
  • Internal damage between vehicle parts without external impact.
  • Intentional damages or those caused by gross negligence.
  • Damage to tires, windows, awnings, roofs, or interiors due to misuse, unless covered by the Premium Guarantee.

Administrative Fees:

  • A handling fee of €49 will be applied for each damage case file.
  • In case of key loss: charges up to €500.
  • In case of document loss: charge of €100. Nomad Wildtracks will assess damages through an authorized workshop or internal expert report, and the renter may provide observations if they disagree.

18. Coverage and Deductible Packages

Standard Coverage (included in all bookings):

  • Deductible of €3,000 per claim.
  • Unlimited mileage.
  • 24-hour roadside assistance.
  • Replacement or repair service subject to availability.

Premium Coverage (optional – €35/day):

  • Deductible reduced to €600 per claim.
  • One-time waiver of the first €1,000 deductible for mechanical breakdowns.
  • Coverage includes damages to tires, windows, roof, and interior components due to accidents or accidents covered by the insurance.
  • Includes cleaning of the vehicle at return.

Exclusions:

  • Any damage caused by gross negligence, prohibited use, or violation of these conditions is not covered.
  • Additional cleaning charges for excessive dirt or damages caused by pets may apply.

19. Tolls and Traffic Fees

The renter is responsible for paying all tolls, restricted access zones, and any applicable traffic fees during their trip.

Important Information:

  • For trips abroad (France, Portugal, Andorra, etc.), the renter must inform themselves and manage any necessary registrations (electronic toll cards, environmental stickers, etc.).
  • It is very important that the renter informs Nomad Wildtracks about their travel plan in advance, so that proper advice can be given if needed and the required documents provided.

Charges for Unpaid Toll Management:

  • If Nomad Wildtracks receives charges or fines for unpaid tolls, the renter will be charged the corresponding amount plus a 19 € processing fee per request.

20. Personal Data Processing and Tracking System

Data Protection:

Nomad Wildtracks will process the renter’s personal data in accordance with the General Data Protection Regulation (GDPR) and only for the proper execution of the contract.

  • Data will not be shared with third parties, except under legal obligation or upon explicit request from competent authorities (toll operators, police, etc.).

Data Stored in the Vehicle:

  • Addresses entered into the navigation system.
  • Information from connected mobile phones (contacts, calls, etc.).

Renter’s Responsibility: The renter must delete this data before returning the vehicle. Nomad Wildtracks is not responsible for data deletion after vehicle return.

Ford Pro Tracking and Telemetry System:

Vehicles are factory-equipped with a geolocation and telemetry system provided by Ford Pro.

This system allows Nomad Wildtracks to access:

  • Location, vehicle technical status, maintenance alerts, general driving data.
  • Exclusive use to ensure safety, manage maintenance, and prevent unauthorized use.

Nomad Wildtracks accesses this data only through the Ford Pro platform, with no commercial purposes or continuous personal tracking.


21. Prohibition of Transfer; Vehicle Ownership

  • Transfer of rights derived from the contract to third parties, including companions or family members, is not permitted.
  • The vehicle is the exclusive property of Nomad Wildtracks and may only be used by persons authorized in the contract.
  • It is prohibited to sublease, sell, mortgage, or use the vehicle as collateral of any kind.

22. Jurisdiction and Statute of Limitations

  • Any dispute arising from this contract shall be resolved under the jurisdiction of the courts of Barcelona.
  • In the event of an accident registered by the police, any claim for damages will only be effective after Nomad Wildtracks has reviewed the official file.
  • The maximum period to submit claims shall be six months after the vehicle is returned.

 

 

Terms and Conditions of Sale

1. Company Identification

This website is owned by Nomad Wildtracks BCN, S.L., with registered address in Cabrils (Barcelona), Spain, VAT number B75764753, and registered in the Commercial Registry of Barcelona. Hereinafter, “the Company”.


2. Purpose

These terms regulate the purchase of fashion products and accessories offered in the online store Nomad Wildtracks.
By placing an order, the customer fully accepts these Terms and Conditions.


3. Purchase Process

  • The customer selects the products and completes the order through the payment gateway.
  • Once payment is confirmed, the Company will send a confirmation email.
  • Product availability is subject to existing stock.

4. Prices and Payments

  • Prices include VAT.
  • Shipping costs are detailed during the purchase process.
  • Accepted payment methods: credit/debit card and others indicated on the website.

5. Shipping and Delivery

  • Shipments are made throughout Spain and European Union countries.
  • Estimated delivery time: 3 to 7 business days in Spain, 7 to 15 days in Europe.
  • The Company is not responsible for delays caused by external factors (strikes, customs, etc.).

6. Exchanges and Returns

  • The customer has 14 calendar days from receipt to return the product.
  • The product must be in perfect condition, unused, and with its labels attached.
  • Return costs will be borne by the customer, unless due to error or defect.
  • The refund will be processed within a maximum of 14 days from receipt of the returned product.

7. Warranty

Products are covered by the legal warranty of conformity established by applicable regulations.


8. Liability

The Company is not responsible for misuse of purchased products or for indirect damages derived therefrom.


9. Intellectual Property

All website content, including images, logos, and designs, is the property of the Company.


10. Data Protection

Personal data is processed in accordance with the website’s Privacy Policy.


11. Governing Law

These conditions are governed by Spanish law. In case of dispute, the parties submit to the courts of Barcelona, unless otherwise required by law.
